1) Agreement to Terms
By accessing berryvillefc.com or summitvalleyunited.com, registering for programs, purchasing tickets or merchandise, or participating in Summit Valley United activities (the "Services"), you agree to these Terms.
2) Eligibility & Accounts
You must be able to form a binding contract, or have parental or guardian consent for minors. You are responsible for your account credentials and all activity under your account.
3) Memberships, Registrations & Fees
- Program availability, fees, seasons, and requirements may change.
- You agree to provide accurate information, including emergency contacts and health disclosures relevant to safe participation.
- Fees, due dates, and late or returned payments may carry charges as stated during checkout or registration.
- Unless stated otherwise in a specific program policy, registration fees are non-refundable except where required by law.
4) Events, Schedules & Weather
Schedules for practices, games, and tournaments are subject to change for field availability, safety, and weather. We will make reasonable efforts to notify participants by email, SMS, or WhatsApp.
5) Code of Conduct
Players, families, and spectators must:
- Demonstrate respect for officials, coaches, players, and staff.
- Refrain from abusive language, harassment, or unsafe behavior.
- Comply with venue rules and lawful instructions from staff.
We may remove individuals who violate this Code without refund.
6) Assumption of Risk; Waivers
Soccer and related activities involve inherent risks of injury. By participating, you or your parent or guardian assume all ordinary risks associated with training, matches, travel, and conditioning, and agree to sign required waivers and medical releases. If you do not agree, do not participate.
7) Health & Safety
You agree to disclose relevant medical conditions for safety planning, comply with concussion protocols, and follow return-to-play guidance. We may require physician clearance after injuries.
8) Communications
By providing contact information, you consent to receive operational communications such as schedules, updates, and last-minute changes. SMS terms: message frequency varies, message and data rates may apply, text STOP to opt out, and HELP for help.
9) Media Release
You grant Summit Valley United a non-exclusive, royalty-free, worldwide license to use your, or your minor player's, name, image, voice, and likeness captured at club events for club purposes, including the website, social media, and promotional materials. To request limitations going forward, use our media request email.
10) User Content
If you submit content such as photos, testimonials, or comments, you represent that you own it and grant us a license to host, display, and distribute it for club purposes. Do not submit unlawful, infringing, or inappropriate content.
11) Payments, Ticketing & Merchandise
All prices are listed before checkout. Taxes, fees, or shipping may apply. Ticket availability, seat assignments if any, and entry conditions are subject to venue rules. Refunds and exchanges apply only as stated at the point of sale or where required by law.
12) Intellectual Property
All content on the Services, including logos, text, and graphics, is owned by Summit Valley United or its licensors and is protected by law. You may not use our marks without prior written consent.
13) Third-Party Services
We may link to or integrate with third parties such as payment processors, league portals, YouTube, WhatsApp, or Twilio. We are not responsible for their services, terms, or policies.
14) Disclaimers
Services are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties to the fullest extent permitted by law, including fitness for a particular purpose and non-infringement. We do not guarantee error-free or uninterrupted Services.
15) Limitation of Liability
To the maximum extent permitted by law, Summit Valley United and its officers, coaches, volunteers, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount you paid to us for the specific program or purchase giving rise to the claim.
16) Indemnification
You agree to indemnify and hold harmless Summit Valley United from claims arising out of your use of the Services, breach of these Terms, or participation in activities, except to the extent caused by our gross negligence or willful misconduct.
17) Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. You consent to exclusive jurisdiction and venue in the state or federal courts located in Clarke County, Virginia, or the nearest competent court.
18) Changes to Terms
We may update these Terms. Continued use after changes means you accept the new Terms.
